HB 3774 – A Bill to Amend the South Carolina Code of Laws By Amending Section 42-1-560, Relating to the Notice Requirement For Filing a Third-Party Action In a Workers’ Compensation Claim, So As to Make the Filing of a Notice Form Permissive.

Summary For 01/31/2025
This measure clarifies that the failure to notify the Workers’ Compensation Commission, employer, and carrier using the required form does not equate to choosing a specific legal remedy.If less than a year remains to file a lawsuit against a third party, and the carrier has accepted liability or made payments under an award, but the injured employee or their representative has not sued or settled, the right to sue transfers to the carrier. This transfer happens at least 20 days after the carrier notifies the employee or their representative in writing that failing to file a lawsuit will result in the assignment. This measure takes effect upon the Governor’s approval.
