SB 2094 – A Bill For an Act to Amend and Reenact Subsection 1 of Section 65-05-08 and Section 65-05-09.3 of the North Dakota Century Code, Relating to the Workers’ Compensation Disability Benefits and Retirement Presumption; to Repeal Sections 65-05-09.4 and 65-05-09.5 of the North Dakota Century Code, Relating to Workers’ Compensation Additional Benefits Payable; and to Provide For Application.

Summary For 01/16/2025
This measure modifies provisions regarding employees’ eligibility for disability benefits if they have retired or withdrawn from the job market.
- Employees who have retired or voluntarily withdrawn from the labor force are ineligible for disability benefits.
- The presumption may be rebutted if the evidence shows that the employee is:
- actively seeking employment;
- available for gainful employment;
- has not rejected a job offer from a former employer or other employer;
- has not provided the employer with a written notice of a scheduled retirement date.
- This presumption does not apply to an employee who is permanently or totally disabled.
This goes into effect on August 1 after enacted.

SB 2181 – A Bill For an Act to Create and Enact a New Section to Chapter 65-05 of the North Dakota Century Code, Relating to Posttraumatic Stress Disorder Duration Limits; to Amend and Reenact Subsection 11 of Section 65-01-02 of the North Dakota Century Code, Relating to Workers’ Compensation Coverage For Posttraumatic Stress Disorder; to Provide For Application; and to Provide an Expiration Date.

Summary For 01/17/2025
This measure amends existing code to establish posttraumatic stress disorder duration limits and other provisions relating to workers’ compensation coverage for posttraumatic stress disorder.
This measure adds posttraumatic stress disorder (PTSD), if the injured employee establishes that the condition causing the PTSD was extraordinary compared to normal emotional strain experienced by similar employees, to be included under the term “compensable injury”.
- Must be diagnosed by a licensed psychologist or psychiatrist
- Determined not to pre-exist the employment event
- May not be the result of any actions, such as a work evaluation or job transfer, taken in good faith by an employer
This measure establishes that disability benefits payable for PTSD may not exceed 32 weeks in duration from first report of injury or two claims in an employee’s lifetime. This measure will take effect August 1 after enacted and will remain in effect through July 31, 2029, before it becomes ineffective.

Summary:
This measure modifies presumptions of retirement for employees seeking workers’ compensation disability benefits. It presumes that an employee who has voluntarily retired is presumed to have left the labor force and is ineligible for benefits. That presumption may be rebutted by actively seeking employment, being available for gainful employment, etc. This section does not apply to a permanently and totally disabled employee.
