Summary For 01/13/2025
This measure provides that when a claimant in a workers’ compensation dispute prevails at the department level, the claimant will be entitled to an award of reasonable attorneys’ fees and costs.

New Hampshire HB 216 – Relative to Workers’ Compensation and Creditable Service Towards Retirement.

This measure removes the one-year maximum for weekly awards from worker’s compensation to be a credible service. This measure goes into effect 60 days after passage.

New Hampshire SB 67 – Relative to Workers’ Compensation and Resolution of Payment Disputes.

Summary For 01/16/2025
Efforts must be made to resolve disputes about the reasonable value of services before seeking the commissioner’s decision. However, an application to the commissioner is allowed only if:
- The healthcare provider notifies the employer or their insurance carrier of the disagreement within 45 days of payment and no more than 45 days have passed since the notification.
This measure goes into effect 60 days after passage.

New Hampshire SB 169 – Requiring Employers to Provide Certain Information Regarding Cost Sharing to Employees Receiving Workers’ Compensation Benefits.

Summary For 01/28/2025
An employer providing supplemental pay to an employee receiving workers’ compensation benefits must notify the employee with a detailed breakdown of payments, expected financial adjustments, withholding costs, and payment method options. The initial notice must be given within 30 days of the injury, with follow-up notices provided every 30 days after that. This measure takes effect 60 days after becoming law.

New Hampshire Case Management
The New Hampshire RSI-A 23-a (effective June 1, 1993) requires that the carrier, TPA or consultant may provide case management services as long as the case manager is certified as an Injury Management Facilitator (IMF).
