HB 719 – Revise Workers’ Compensation Laws Relating to Designation of Treating Physician

This measure bars an employer or workers’ compensation insurer from requiring an employee to use a particular treating physician. It does not list an effective date.

HB 678 – Generally Revise Worker’s Compensation Laws

Summary:
This measure provides that the claimant has the burden of proof on a more probable than not basis for all matters at issue.
The measure prohibits an insurer from charging a fee for processing claim-related. The measure provides that an insurer is entitled to medical information relating to prior workers’ compensation claims, restrictions, injuries, and impairments, regardless of body part. The measure also provides that if an insurer terminates biweekly compensation benefits and the termination of compensation benefits is disputed by the claimant, the department may order an insurer to pay additional biweekly compensation benefits prior to a hearing before the workers’ compensation court if the claimant demonstrating, on a more probable than not basis, that the claimant will prevail.

SB 496 – Revise Workers’ Compensation Definition of Wages Related to Lodging

This measure allows for the administrative valuation of lodging, rent, or housing as part of worker renumeration to be updated annually. It does not list an effective date.

Managed Care Organization (MCO)
The Montana Rule 24.29.2311 (effective July 1, 1993) allows an injured worker to choose a Managed Care Organization (MCO) from a list of certified MCOs provided by the insurer. If the injured worker does not select a MCO within 7 days, the insurer may select a MCO for the injured worker. The MCO will designate a treating physician for the injured worker appropriate to the injury. Once an injured worker has entered into a MCO and a treating physician has been selected, the injured worker may not change the MCO or the treating physician without approval from the insurer.
